DPCM (Prime Ministerial Decree) of 12 January 2017 on Livelli Essenziali di Assistenza (LEA) (Minimum Health Assistance)

Novelties concerning foreign citizens’ access to the Servizio Sanitario Nazionale (SSN) (National Health System)

The DPCM of 12 January 2017 was published in the Gazzetta Ufficiale No. 65 of 18 March 2017 providing the new Livelli essenziali di assistenza - LEA.

The new Decree substitutes the DPCM of 29 November 2001, which defined for the first time the activities and services that the Servizio Sanitario Nazionale (SSN) is obliged to provide all citizens, free of charge or upon payment of a participation share (ticket), through resources collected with general taxes.

Articles 62 and 63 refer to citizens not belonging to the European Union.

The most important novelty concerns foreign minors. In fact, as regulated "Foreign minors present on the national territory, even if not in order with entry and stay laws, are to be registered to the Servizio Sanitario Nazionale (SSN) and can make use of health assistance on equal terms with Italian citizens" (article 63, paragraph 4). In this sense, the DPCM clarifies several doubts raised in the territories in these years concerning the binding or non-binding nature of the 2012 Agreement and whether or not it needed to be adopted with acts issued by the single Regions.
